　　根據(jù)《中華人民共和國民法典》和交通運(yùn)輸部有關(guān)規(guī)定，為明確雙方的權(quán)利和義務(wù)，經(jīng)雙方協(xié)商一致，簽訂汽車租賃合同，設(shè)定下列條款，共同遵守。

　　一、租賃情況

　　1、乙方因____________________需要向甲方承租車輛，租車期限自__年__月__日__時__分至__年__月__日__時__分。

　　三、乙方的權(quán)利義務(wù)

　　1、乙方提供給甲方的資料應(yīng)保證真實(shí)有效(如身份證、戶口簿、駕駛證、單位營業(yè)執(zhí)照副本等)否則就此產(chǎn)生的責(zé)任均由乙方負(fù)責(zé)。

　　2、乙方認(rèn)真檢查并掌握租賃車輛的各種性能和操作方法，點(diǎn)清車輛附件，驗(yàn)收簽字后駛離。

　　凡因乙方操作不當(dāng)，保管不善造成車輛遺失或造成附件損壞，乙方應(yīng)向甲方賠償。

　　3、乙方租用的甲方車輛不能從事其它營業(yè)性客貨運(yùn)輸、不能轉(zhuǎn)租、轉(zhuǎn)包、抵押、投資、贈與，不能賦予自己對車輛任何超出本合同規(guī)定的其它權(quán)利，不能私自拆裝甲方的車體(件)否則甲方有權(quán)收回車輛并要求乙方賠償所造成的損失。

　　4、乙方利用租賃車輛從事非法活動，轉(zhuǎn)租所導(dǎo)致的后果，均由乙方負(fù)責(zé)，同時甲方有權(quán)解除合同。

　　5、乙方租用車輛除繳納租金外，另須繳納押金，(押金為現(xiàn)金，支票需三天扣提車)乙方不可以押金視作租金使用。

　　6、乙方要求延長汽車租賃合同，必須提前到本公司辦理延期手續(xù)。

　　還車時應(yīng)保持車內(nèi)外的清潔，否則將收取20元清理費(fèi)。

　　7、乙方合同到期不按規(guī)定還車，又不辦理延期手續(xù)，按延時實(shí)際小時收取每小時超時費(fèi)20-40元，租車以每天24小時為一租車日計算，平均每天使用不超過200公里，根據(jù)不同車輛每超過一公里加收租費(fèi)1-3元。

　　8、車輛發(fā)生事故，乙方應(yīng)立即通知甲方及有關(guān)部門，車輛修理由甲方安排修理地點(diǎn)，乙方不得擅自安排修理，一旦車輛損壞，禁止繼續(xù)使用，乙方應(yīng)全力配合交通管理部門處理好車輛事故，發(fā)生交通事故造成人員傷亡時，將按照交通管理條例處理。

　　9、車輛發(fā)生事故，修理費(fèi)由乙方預(yù)先支付，在停駛或修理期間的租費(fèi)由乙方承擔(dān)，同時還應(yīng)賠償本車輛加速折舊費(fèi)，折舊金額按修車實(shí)際發(fā)生額的50%計算。

　　若發(fā)現(xiàn)乙方發(fā)生事故不報告，擅自修理將按正規(guī)修理費(fèi)的3倍罰款。

　　10、乙方在承租期間，若遺失牌照或有關(guān)證件，乙方應(yīng)向有關(guān)部門申請補(bǔ)辦，補(bǔ)辦期間的車輛租賃費(fèi)及補(bǔ)辦手續(xù)費(fèi)，由乙方承擔(dān)，直至車輛能正常行駛時為止。

　　11、乙方在用車期滿，應(yīng)完好無缺損將車輛交給甲方。

　　不得卸下里程表和故意損壞里程表，如有發(fā)生按日里程1000公里收費(fèi)，不得更換車輛零部件。

　　12、嚴(yán)禁酒后開車，嚴(yán)禁使用車輛進(jìn)行違法活動、當(dāng)教練車、參加競賽及作測試使用，嚴(yán)禁裝載易燃、易爆易腐濁物品。

　　13、按照中國人民保險公司的條款規(guī)定，車輛發(fā)生意外時保險公司實(shí)行限額賠償，乙方須承擔(dān)保險限額以外的所有費(fèi)用，甲方所投保的第三者責(zé)任險僅限于甲方允許的駕駛?cè)藛T。

　　14、全車丟失后至保險公司賠償前，該期間的租賃費(fèi)由乙方承擔(dān)。

　　15、賠償時，乙方應(yīng)向保險公司提交保險單，事故證明，事故調(diào)解結(jié)案書，損失清單和各種有費(fèi)用的單據(jù)，如實(shí)填寫機(jī)動車輛出險報告單。

　　16、乙方在車輛租用期間，汽油、潤滑油、路橋費(fèi)、停車費(fèi)自行負(fù)責(zé)。

　　四、擔(dān)保方的權(quán)利、義務(wù)

　　1、擔(dān)保方同意作為本合同乙方的保證人，保證乙方完全履行本合同中的全部義務(wù)，擔(dān)保期限直至乙方完全履行義務(wù)為止。

　　2、如乙方不能履行合同或違約時，則由擔(dān)保方承擔(dān)連帶責(zé)任，甲方可以直接向擔(dān)保方提出要求。

　　3、本擔(dān)保與乙方實(shí)際租賃期間產(chǎn)生的債權(quán)。

　　本擔(dān)保系不可撤銷的擔(dān)保，并獨(dú)立于本合同其它條款，不以合同無效而無效。

　　五、其它

　　1、以上有約定的按約定處理，其它有違約行為的，違約一方負(fù)有賠償對方損失的責(zé)任。

　　5.4 發(fā)生5.3條款情形，押金不足抵付時，乙方必須按接到甲方付款通知后十天內(nèi)補(bǔ)足。
